By visiting Emily June, you agree to accept and abide by all of these terms and conditions.
Privacy Policy
Emily June is committed to protecting your privacy and will not disclose your personal information (name, phone number, website information, address, and email) to any other companies or individuals without your permission. Additionally, Emily June will never sell your personal information. You may choose to opt out of any email correspondence that you may receive. Just follow the steps to unsubscribe or please send an email stating your request.
Copyright Notice
All content and images on this site belong to Emily June and are protected by U.S. Copyright law. Please do not copy these without permission. None of the graphics, designs, layouts, formats or template codes are to be altered, changed, shared or resold for any reason. The client is only allowed to use the completed design on one website. Use on multiple websites is not permitted (unless specific permission has been granted by Emily June).
In some cases this work may be shared per the Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 United States License, but only if you attribute it to Emily June and do not alter or transform it in any way. Emily June respects the intellectual property of others and if you believe that your work has been used in a way that constitutes copyright infringement, please contact me.
Authorization and Access
By scheduling your project and submitting a deposit for a custom blog design or pre-made blog template, the client authorizes Emily June to access their website account and Hosting Service with full access to files and other programs needed for the design project that are included as part of the client’s design service.
Project Schedule and Waiting List
All clients will be fully aware of their estimated project start date at the time of scheduling. Some projects may be scheduled as far as two months out due to Emily June’s waiting list. Emily June has the right to extend a project’s start date or cancel a project for any reason at any time. If a project has been cancelled by Emily June and a deposit has already been paid, only in this case will the client’s deposit be returned.
If the client isn’t ready to work on the design, cannot be contacted or has not responded within three days at the estimated time agreed upon, the project will be cancelled and the initial deposit will not be refunded.
Project Completion
A website project may take up to 2 or 3 weeks to complete and Emily June has the right to extend the project completion date if needed due to the client request, designer request or project complexity.
Revisions
Custom blog projects & logo designs include 1 major revision and 1 minor revision after a rough draft has been sent to the client. Smaller projects such as buttons and banners include only 1 major revision after the rough draft has been sent. For any other revisions, an hourly design fee of $30 will be charged to the client in addition to the original design quote.
Compatibility Guarantee
Emily June guarantees that each design project, layout, image, favicon and logo completed will be tested for compatibility in the latest browser versions of Internet Explorer, Mozilla Firefox and Safari. Emily June is not responsible for browser design errors that may occur after the design is installed and has become the client’s responsibility to maintain.
Design Error Corrections
Emily June will do the best possible to provide a design that meets the client needs and requests. Emily June also guarantees the design project will be free from visible errors that may affect the layout or design.
Some errors are inevitable, and Emily June agrees to correct any design errors during one week (7 days) after the design has been installed on the client’s account. The errors includes typos, bad links, or browser inconsistencies. This does not include changing the design, replacing images or any other content elements.
Any additional errors that need attention after 7 days will require the full service fee amount or an hourly design fee of $30.
Payments
Payment for all design projects and services is currently offered through Paypal. Checks (personal or business) will not be accepted under any circumstances.
Emily June requires a custom blog deposit and logo deposit of 50% of the quoted payment price upfront. This payment will be collected when the project is scheduled. Emily June will then be paid in full upon the delivery of the finished website project. The first payment deposit will be 50% of the estimated project price and may vary from project to project depending on the type of design and services involved. The full price for headers, banners and buttons will be required upfront.
This price is subject to change and additional fees may apply in the final payment if the client adds new service requests to the project after the initial quote.
Refunds
Refunds will not be given under any circumstances. Custom blog design deposits are non-refundable – even if the client decides to withdraw their project before the design process has begun.
Credit Links
The client agrees to have a credit link to Emily June placed on the footer of their website. The client agrees not to remove or hide this linkback. However, if a client does not want a link back listed on their site, a fee of $75 may be paid to have the credits removed.
Client or Third Party Damage
In no event will Emily June be liable to the client or any third party for any damages or lost finances, due to the inability to operate the webpages or website. Emily June will not be responsible for loss or damage caused by the failure, use or misuse of the website’s software, loss of software, hardware or any other natural events beyond the control of Emily June.
Portfolio
Emily June reserves the right to display all finished images, design elements, logos and graphics in her project notes and online portfolio as an example of previous work.
Additional Information
It is the responsibility of the client to save and store a backup of all images and designs. It is not the responsibility of Emily June to save the existing design or image elements. Additionally, Emily June is not responsible for any lost website content that may occur when under the responsibility of the client.
The client is choosing Emily June’s services based on the style and quality of design represented in her portfolio work. Before submitting a deposit, the client must feel confident in Emily June’s work and agree to be flexible in his/her design requests. While Emily June will do the best possible to fulfill each client’s website design vision, some client requests simply may not be possible.
iStock Photo and Scrap Kits
iStock images and Scrap Kits are NOT included in the price of a custom blog design. If the client would like to include a specific iStock image or Scrap Kit in their design, it is the responsibility of the client to purchase the image, graphic or kit and follow the specific commercial-use license rules for each site.
Please note that istock images cannot be used for official logos or for print work UNLESS an extended license is purchased for the image. Emily June is not responsible for any problems or concerns that may arise with iStock Photo if the client has failed to acknowledge and follow the extended license rules and requirements for their image or logo.
Additionally, scrapbook websites with scrap kits have their own set of rules that determine whether an item may be used for personal or commercial use. When working with Emily June, the client is responsible to follow each set of rules and instructions regarding the use of scrap kits for commercial use on their website. Emily June is not responsible for any problems or concerns that may arise with a specific scrap kit if the client has failed to acknowledge and follow the commercial license rules and requirements for their specific design.
Premade Themes
Premade themes and designs are sold as is after initial installation, photo integration and title customization. It is the responsibility of the client to maintain the design and website and obtain their own support for website maintenance and upkeeping. Emily June will not be responsible for any changes to the design made by the client or a third party.
The client understands that all premade themes are for personal use and any and all graphics and image content on the premade themes at the date of purchase belong to Emily June. The client does not have the right to claim, reuse, resell or redistribute any design, theme or design image or element without prior, written permission of Emily June.
